Marriage Hadith Series 5 Marriage Guardians

Marriage as other worship in Islam consists of a number of pillars that must be fulfilled. The pillars consist of the two bride and groom, marriage guardian, two witnesses, as well as Ijab and Qabul.

The existence of a guardian is considered as something that also determines whether a marriage is valid or not. A guardian, who is defined as a person who has power and authority over a woman or girl who wants to enter into a marriage contract, is one of the pillars of marriage.

There are three groups of people entitled to occupy the position of guardian, namely:

a. Nasab guardian, namely a guardian who has a kinship relationship with the woman who will marry.

b. Wali mu'thiq, namely the guardian for a slave who was once freed.

c. Judge guardian, namely a person who becomes a guardian in his position as a legal official (judge) or ruler. In this case the authority of the nasab guardian passes into the hands of the judge, if there is a conflict between the guardians or if the guardian is absent (dead, missing) or because he is unable to attend. Then the guardian of the judge has the right to make a marriage contract, unless the woman and the man who want to marry are willing to wait for the arrival of the absent guardian. In a hadith it is stated:

"Three things should not be delayed, namely: prayer when the time has come, the body when it is ready, and a woman when she has found a suitable partner." (H.R. Baihaqi)

Because of the importance of the existence of this guardian, to the extent that Rasulullah SAW said:

Zuhri narrated from Aisyah that the Prophet SAW said: whoever a woman marries without the permission of her guardian then her marriage is void (HR. Ahmad)
