From the companions of Muâz bin Jabal, in fact the Messenger of Allah. when sending Mu'âdz to Yemen he said: "How will you punish if one case comes to you?". He (Mu'âdz) replied: "I will punish with the Book of Allah". His words: "What if it is not in the Book of Allah?". He replied: "I will punish with the Sunnah of the Prophet". He said: "What if it is not found in the Sunnah of the Prophet?". He replied: "I make ijtihad with my mind and will not back down, the Prophet also said: "Praise be to Allah who has given taufiq to the messenger of the Messenger of Allah."

Guided by this message, the Companions and Tabi'in then made ijtihad when they did not find evidence from the Al-Quran or As-Sunnah which explicitly regulates a matter. This ijtihad of friends and tabi'in gave birth to fiqh.

Differences in the quantity of hadith by the tabiin, coupled with their differences in setting quality standards for hadith as well as the situation and conditions in different regions lead to differences in the results of their ijtihad. In addition, differences in the results of ijtihad are also supported by the level of use of reason (ratio), which in turn led to the emergence of several schools of thought in fiqh.

The laws in Islam basically consist of two levels, namely sharia and fiqh. The difference is that in sharia there is no need for the mujtahid's ijtihad, because the basis is the muhkam's arguments.
