" This law is quite important in the area of ​​parody. It indicates that a work created by combining other works or parts of them is to be considered autonomous if it were the result of an artistic choice. Law cited extracted from article 4: "Without prejudice to the rights existing on the original work, the elaborations of a creative nature of the work itself, such as [...] transformations from one into another form are also protected [...] artistic, the modifications and additions that constitute a substantial remake of the original work, the adaptations, the reductions, the summaries, the variations that are not constituting the original work. " In this law it is emphasized that the modifications and additions made to an already existing work (in the case of the parody a new elaboration of new texts, new amateur scenes, writings, special effects, own images, etc.), are protected and without prejudice to existing copyright. Directive 2001/29 / EC of the European Parliament and of the Council of 22 May 2001 (OJ n. L 167 of 22/06/2001), extracted from article 5: "The acts of [...] are exempted from the right reproduction [...] without economic importance of their own which is an [...] integral and essential part of a technological process [...] ", in particular paragraph 3 letter K" when the use takes place for the purpose of caricature , parody or pastiche. " This directive is specific to parody. In this sense, the law specifies that it is possible to distribute a parody work without profit and without having to submit to existing copyright. " Article 21 of the Italian Constitution, "Everyone has the right to freely express their thoughts with speech, writing and any other means of communication". The right of "satire as a fundamental constitutional right" is therefore assured.
