Shariah Law and Economics

Etymologically the word law, known in Indonesian language derived from the Arabic "hukm" which means the decision (judgment) or provisions (Provision). In the Encyclopaedia of Islamic law, the law means set something on something or abolish them.

From the viewpoint of Islam, Sharia equal terms with the Shari'a (ta marbuthoh behind read ha) which leads to a growing sense of meaning fiqh. Thus the meaning of Islamic Economics is the principal arguments of the economy is in the Qur'an and Hadith. This gives the demands of the Islamic community to create and implement economic and legal system of economy based on the arguments that existing principal in the Qur'an and Hadith. Accordingly, these terms, when called by the short term is as an Islamic Economic System and Economic Law Sharia.

Legal and economic linkage is one of the classic bond between law and social life. In light of the economy, the need to use the law as one of the institutions in the community helped determine the economic policy to be taken. The importance of understanding of the law because the law regulating the scope of human activity pasa almost all areas of life, including in economic activity. Besides, the law memeiliki another role, namely its ability to influence the level of certainty in the relationship between humans within mesyarakat.

In the jungle of uncertainty which will greatly affect the economic policy measures to be taken, then the befungsi legal provisions to regulate and restrict the range of economic activities in the hope of economic development does not ignore the rights and interests of the community. To protect the rights and interests of people who are generally manifested in a formal law aims to achieve the goals and objectives to be achieved in economic development.

For this reason, in recent decades recognized the relationship between economic erta with the law so often called the law of economics.
